Prime Minister in Corruption If P.M. is associated with any kind of corruption, CBI will investigate it. CBI is under the guidance of PM. Then how will it investigate against him. If PM wants to be out from any kind of quiz, Government should modify the laws in the constitution. Why to confuse the people like this. According to Anna’s bill, Lokpal and independent agency will investigate Prime Minister’s involvement in corruption.
Protection of Citizen who complained CVC, an official who had no power and no resource would be liable to protect the complainer. Lokpal will ensure the protection of citizens who filed the complaint. Lokpal will have proper rights and resources to do so.
Corruption by a Member of Parliament. A parliamentary committee should investigate the cases of vote for money, bribery and paid questions. In the last 62 years, there are hundreds of cases suggesting vote for money but till now no honest investigation took place and no M.P. was criminalized. Anna Hazare’s bill says that Lokpal will independently investigate and analyze such cases.
Selection of Members in Lokpal Committee
1.) 10 member committee will include 6 leaders. By this government will make a weak Lokpal which will be of no use.2.) Committee will look after selection process. 1.) 10 Member committee will include 2 leaders, 4 Judges and 2 persons from a constitutional position.2.) The selection process is very long and it will involve a full participation of public.
Bribery at offices A citizen charter will be developed and a time period for a specific work would be mentioned in it but if a government employee fails to do the work in the given time frame what will happen? Government has no answer on this, so what is the need of a Citizen Charter and why will a government officer abide to it. If Citizen Charter is ignored then the said employee will be punished by Lokpal and a fine will be imposed on employee which will be paid to citizens.
Reporting of Lokpal Members All members will report to Government only. Only government will be able to remove any member by filing a petition in the Honorable Supreme Court. Members reporting will be directly towards general public. Any citizen can remove a corrupt Lokpal member by filing a case in Honorable Supreme Court.
Corruption in Lokpal Staff Lokpal will be the only body to hear the cases and that will make it of no use. In turn Lokpal office will turn into home of corruption A Complaint Commission will be setup in each state and it will investigate the breaching in Lokpal Staff. Process will take a month time only and if found guilty, the staff member will be terminated from duty.
Reach of Lokpal Lokpal will cover ‘A’ grade officials under central government. No officials and employees below ‘A’ grade position will come under it. Over 80% corruption takes place in the region below ‘A’ grade like Panchayats, Road, School, Hospital etc. This will help rich citizens only. Each employee under Central government will come under Lokpal. On the verge of Lokpal, a Lokayukta will be made in states to check corruption at the state level. The complaints would be made directly to Lokpal and Lokayukta.
Punishment to Corrupts Maximum 10 years of punishment. Maximum punishment of Life Sentence in Jail. Higher the official, bigger the punishment.
Judicial Corruption A three member committee consisting of three judges of the same court will approve the investigation. How a committee from same court will ever grant permission for investigation. Anna’s Janlokpal bill says that a Seven member committee of Lokpal will make an open hearing to such corruptions.
Removing the Corrupt Official Minister from the same department can only remove an official who is found corrupt. An open hearing will take place to take a decision on the removal of a corrupt official. Lokpal committee will discuss the issue.
